Illinois Wrongful Death Lawyers
When a loved one dies in an accident the consequences for the survivors can be both financially and emotionally devastating. Illinois has two ways for survivors to recover. One way is under the Illinois Wrongful Death Act, and the other is under the Probate Act, known as a Survival Action. There are tax and other important implications between a Wrongful Death recovery versus a Survival Action. When a person dies in an accident the Illinois Survival Act allows the Estate of the deceased to maintain a suit for recovery. The Wrongful Death Act is different. It allows the survivors to recover for loss of support and emotional damages. Understanding the difference between these two Acts is an important factor that many lawyers don’t fully appreciate. If a death is instantaneous, for example, a Survival Action may fail. Creditors and medical care providers may have the right to assert claims against the recovery in some instances, but not in others.
